Process Service via Facebook? Really?
Process service via private message on Facebook? Surprisingly, this is not anything new, but it seems to be a few and far between type of circumstance for the time being with a lengthy due-diligence involved. Process service happening via social media: it’s happening more often as time progresses into a technological age. With a vastly growing social network, one may argue that a social media account might be more common than a mortgage or lease agreement. We are not stating that this is the normal way to go about process service. This highly controversial method may yet have a deep effect on the future of process service and what constitutes “service of process” according to that states statutes. If people to continue to clearly impede the service of process and are active on social media, a judge may rule for this as a last resort (maybe).
For now, this will definitely be something that is determined on a case by case basis. Don’t be surprised if you are served by a hash tag or photo in the next 5-10 years or so. Who knows, maybe process service via Facebook or other social media will become a more normal part of alternate means of service.
